Because that is what I want to see! I am not in favor of mandatory sentencing. I am completely in agreement with defense attorney’s on this issue. People have reason’s for doing what they do, I make a distinction between a death that was caused by a provocative act; for example, If a war hero coming back from Iraq and gets into a fight with some people who are calling service people killers vs somebody who shoots a child in the head for no apparent reason.

I expect the judgment to fit the circumstances of the crime. Police should use their better judgment when checking people’s records. I expect this because I know that judgment can not be written into the law. Any attempt to write judgment into a law would make the law far to complicated, to have a functional justice system we must allow people to use their judgment.

    Our judicial system made a serious left turn about 40 years ago. This major shift has destroyed the carefully built foundation laid out over 100 years of cases and decisions.

    The key issue is foreign law and personal persuasion was introduced into legal opinions. Our constitution was no longer the source document and previous case and president was no longer the basis of new judgment. We tossed all this aside.

    This lack of consistency and incompetence that started showing itself in all areas of legal discernment forced common citizens to take case law into their own hands.

    Until we return our judicial system back to its foundation we will continue to suffer under broad reaching poorly written mandatory sentencing.

    Thanks for your well thought out response. I agree with you about the key issue.

    I fear however that the situation is getting worse in that the executive branches are giving out punishments in an attempt to avoid the court system; I don’t have a good example of this today however.
