Because that is what I want to see! I am not in favor of mandatory sentencing. I am completely in agreement with defense attorney’s on this issue. People have reason’s for doing what they do, I make a distinction between a death that was caused by a provocative act; for example, If a war hero coming back from Iraq and gets into a fight with some people who are calling service people killers vs somebody who shoots a child in the head for no apparent reason.

I expect the judgment to fit the circumstances of the crime. Police should use their better judgment when checking people’s records. I expect this because I know that judgment can not be written into the law. Any attempt to write judgment into a law would make the law far to complicated, to have a functional justice system we must allow people to use their judgment.

I would agree with the police in not looking up the criminal record of ANYBODY (black, White, or Grey) who is reporting a crime, unless they have a really good reason (IE if Osama Bin Laden reports a crime and they recognize him from wanted posters — even if he is a victim of abuse)! However I believe that the police should have an obligation to check the records of people who they are arresting for committing a crime — Which is what New Jersey failed to do — What failed to happen in Arizona and I certainly hope they check the records in this case. I don’t care who you are if you commit a crime — an American who smuggles drugs from Mexico and gets arrest should have his records checked too.

Makes me wonder? maybe Osama Bin Laden (as an undocumented John Doe), is in jail for a minor offense and they are going to let him out in 30 days!
